Dutch courts uphold the Opti-myst patents

Opti-myst effect

By judgment of 4 May 2016, the preliminary relief judge of the District Court The Hague in The Netherlands has provisionally held that by marketing and supplying a range of electric fires known as 'Mystic Fires', Ruby Décor BV (also trading under the name Ruby Fires) and Aparto BV have infringed a patent owned by Basic Holdings, a group company of the Glen Dimplex Group.

The Court ordered an injunction, a recall and account of sales and also ordered Ruby Décor and Aparto to pay EUR 97,663 as a cost award in legal fees. Apart from the Netherlands, the Court also imposed an injunction against Ruby Décor for Germany, France, Ireland and the United Kingdom.
